When you go on parental leave, special rules apply to parental leave benefits. Here is an overview.
To receive parental leave benefits as an employee, you must meet three conditions at the start of your leave:
· You must be employed on the first day of your leave or the day before.
· You must have worked at least 160 hours during the last four full months.
· You must have worked at least 40 hours per month in at least three of those four months.
In addition, it is a requirement that you physically spend time with your child every day during the leave.
If you receive salary during your parental leave: If you are paid full salary for part of your leave, you should only apply for parental leave benefits once your employer stops paying your salary. If you receive full salary throughout your entire leave, you do not need to apply for parental leave benefits.
If you extend your parental leave: If you choose to extend your leave by up to 14 weeks, you are only extending the time off. You are not extending your entitlement to parental leave benefits. Therefore, you cannot spread the payment of benefits over a longer period than the 24 weeks you are normally entitled to (plus any weeks that have been transferred to you).
